Ferguson Buick GMC Texting User Agreement
This Ferguson Buick GMC Texting User Agreement (the “Agreement”) applies to your use of this Customer Sales & Service Retention (the "Service") provided by or on behalf of your GM dealer and/or its service providers (“us”, “our” and “we”), By using the Service, you agree to the below terms and conditions.
- The Service is intended to provide you with text messages regarding vehicle service reminders, connected car alerts, special offers, coupons, recall messages, loyalty opportunities, helpful tips like connecting with Bluetooth and / or other marketing communications. We and/or our service providers may use an autodialer to deliver text messages to you.
- Message & data rates may apply. Service available on participating carriers only. For help or information text ‘HELP’ to (866) 898-0815. Consent is not a condition of purchasing products or services and you may revoke your consent by texting ‘STOP’ at any time. To stop receiving messages text ‘STOP’ to (866) 898-0815
- There is no fee from GM or its dealer to receive messages. Message & data rates may apply– this can be checked with your mobile service provider. You are responsible for any applicable charges when you opt-in for the Service. Charges are billed and payable to your mobile service provider or deducted from your prepaid account. Consent is not a requirement for purchase.
- Text message frequency may vary. Texts may be sent using an automatic telephone dialing system.
- Data obtained from you in connection with this SMS service may include your cell phone number, your carrier’s name and the date, time, and content of your messages. We may use this information to contact you and to provide the services you request from us. You agree to provide us with your valid mobile phone number. If you get a new mobile phone number, you will need to sign up for the Service with your new number.
- We will not be liable for any delays in the receipt of any SMS messages as delivery is subject to effective transmission from your network operator.

- As a subscriber of the Service, you will receive text messages to the mobile phone number provided. You can unsubscribe from this Service at any time by texting ‘STOP’ to (866) 898-0815.

- Alerts sent via SMS may not be delivered if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless carrier may interfere with message delivery, including the customer’s equipment, terrain, proximity to buildings, foliage, and weather. The wireless carrier does not guarantee that alerts will be delivered and will not be liable for delayed or undelivered messages.
- We reserve the right to suspend or terminate the Service at any time without notice to you. This Agreement may be revised at any time. If you are a subscriber of the Service, a text message will be sent to you to note that this Agreement has been updated. If you continue to use the Service after receiving this notice, you thereby agree to the updated Agreement. We reserve the right to change our telephone numbers (including but not limited to, short and long codes.) You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
- You will indemnify, defend, and hold us, GM, Epsilon Data Management, LLC, their affiliates, and their respective employees, principals (shareholders or holders of an ownership interest, as the case may be), service providers, and agents harmless from and against any and all losses, damages, costs, expenses (including court costs and reasonable attorneys’ fees), judgments, assessments, fines, and other liabilities arising out of or resulting from any third party claims or suits arising out of or resulting from Your failure to comply with the terms and conditions of this Agreement.
